2. Studio Products & Preview Betas
Nyxen operates live software platforms (Rankly, NyChat, and Venz AI) and occasional early-access preview products. For pre-release software, access is provided on an experimental basis. Features may change, evolve, or be temporarily modified during development iterations as we incorporate user feedback.
3. License & Acceptable Use Policy
We grant you a personal, non-transferable, non-exclusive, revocable license to access our applications. You agree not to reverse engineer, scrape internal system endpoints with malicious high-frequency bots, attempt unauthorized penetration testing, or utilize platforms to transmit defamatory, illegal, or harassing material.
4. Intellectual Property Rights
All visual designs, brand marks, logos, user interfaces, proprietary auditing algorithms, prompt frameworks, and software architectures associated with Nyxen products are the exclusive intellectual property of Nyxen Studio. You may not duplicate, redistribute, or republish brand assets without prior written consent.
5. Ephemeral Architecture & Data Handling
Certain Nyxen platforms (such as NyChat) are architected around strict ephemeral data principles where messages exist only in transient memory and are never persisted to long-term databases. For platforms requiring waitlist onboarding, we handle email entries in accordance with our Privacy Policy with strict encryption.
6. Disclaimers & Limitation of Liability
Our software is provided 'as is' and 'as available' without warranties of any kind, whether express or implied. While we strive for 99.9% reliability, Nyxen Studio shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from downtime, network errors, or search engine algorithmic changes.
7. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with applicable governing regulations, without regard to conflict of law principles. Any legal disputes arising under these terms shall be resolved through good-faith negotiations or competent courts.
